This agreement applies to domain name services provided by DrivenHost and is part of the Terms of Service. DrivenHost acts as a reseller of an ICANN-accredited registrar (the "Registrar"). By registering a domain through us you also agree to the Registrar's registration agreement and to the policies of the registry that operates the top-level domain, including ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP) and, for .ca domains, the policies of the Canadian Internet Registration Authority (CIRA), including its Canadian Presence Requirements.
1. Registration
You must provide accurate and complete registrant, administrative and technical contact information and keep it current. Providing false information, or failing to respond to an enquiry about the accuracy of your information within 15 days, is grounds for cancellation of the registration. Registrations are not complete until accepted by the registry. We do not guarantee that any name will be available or accepted.
2. Ownership
The domain is registered in your name as registrant. DrivenHost does not claim ownership of your domains. You may transfer a domain away from us at any time, subject to the registry's transfer rules (most registries impose a 60-day lock after registration or a change of registrant). We will provide the authorisation code within two business days of a verified request.
3. Renewal and expiry
Domains renew automatically before expiry unless you disable auto-renewal in the client area. We send reminder notices to the email address on file, but it is your responsibility to ensure a valid payment method is available. If a domain expires, it may enter a redemption period during which restoration carries a registry fee, after which it is released and may be registered by anyone. Domain fees are non-refundable once submitted.
4. Privacy
Where the registry permits, registrant contact details are protected by a privacy service so that they are not published in the public WHOIS / RDAP database. Some registries require publication of certain details; .ca individual registrants receive privacy protection by default under CIRA rules.
5. Disputes
Disputes about the rights to a domain name are resolved under the UDRP or the relevant registry's dispute policy, not by DrivenHost. We will comply with decisions issued under those policies and with court orders.
6. Our rights
We may suspend or cancel a domain registration where required by the registry, the Registrar, ICANN or a court, where the registration information is false, where the domain is used in breach of the Acceptable Use Policy, or for non-payment.
7. Limitation
Our liability in relation to domain services is limited to the fees you paid for the affected domain in the preceding 12 months. We are not liable for loss of a domain resulting from your failure to renew, inaccurate contact details, or a dispute decision.
